1. General Provisions
1.1. This Privacy Policy of the mobile application (hereinafter referred to as the Application) applies to the information that the Operator may receive from the user's device during their use of the Application.
1.2. The use of the Application implies the user's unconditional consent to this Policy and the terms of information processing specified herein, obtained from the user's device. If the user disagrees with the Policy, they must refrain from using the Application.
1.3. This Policy applies only to the Application. The Operator does not control and is not responsible for information (or the consequences of its transfer) provided by the user to third parties, if such a transfer occurred on a third-party resource that the user may have accessed through links from the Application.
1.4. The Operator has the right to make changes to this Policy by publishing a new version of the Policy on the Operator's Official website and/or in the Application. The responsibility for independently reviewing the current version of the Policy lies with the User.
2. List of Terms and Definitions
2.1. The following terms and definitions are used in this agreement:
User Information – the User’s information (including personal data) that may be obtained from the User's Device when using the Application.
Content – all objects independently posted by the User in the Application, including design works, graphic, text, audio, photo, and video works, and any other objects and collections thereof, which may or may not be objects of intellectual property rights, whose rights (including exclusive rights to intellectual property objects) belong either to the User or to other right holders.
Operator – the licensor, Limited Liability Company “CUBER TECH,” abbreviated LLC "CUBER TECH" (TIN: 9726024777, KPP: 772601001).
Official Website of the Operator – the Operator’s website on the Internet – http://cubertechfzco.com/
Policy – this policy regarding the use of the mobile application.
User – the licensee, an individual (Client), who is at least 18 years old, has installed the Application on a Device, and has completed the registration process.
Application – the computer program named "CUBER TECH Mobile Application," the exclusive rights to which belong to the Operator by virtue of its creation.
Device – a mobile technical device (smartphone, tablet, or other device) with Internet access on which the Application is installed.
3. Composition of User Information Processed
3.1. The Operator may process the following categories of User Information when the User uses the Application:
(1) information (including personal data) provided by the User during registration (creating an account) using their mobile phone number, such as name, surname, mobile phone number, email address;
(2) information (including personal data) provided by the User when filling in the corresponding field in the user's profile settings in the Application, such as a photo;
(3) content posted by the User in the Application while using the Application’s features and services;
(4) the date and time of accessing the Application’s features and services;
(5) information about the User's activity while using the Application's features and services;
(6) technical information (network address of the user’s device, session duration, information about the user’s device (type, manufacturer, and model of the device, name and version of the operating system), geographic address of the user’s Internet connection point, location information at a specific moment in time (refers to the location of the user’s device, if geolocation features are enabled on the user’s device); user alias, information about the fact, date, time of user registration, information about the fact, date, time of user deregistration, information about the fact, date, time of user authorization, information about the fact, date, time of user deauthorization).
3.2. Additionally, under this Policy, the Operator is entitled to process statistical information (statistical information does not contain users' personal data) and metadata (this is data that describes the content (including keywords used to retrieve documents), the structure, and the context of other data, as well as the management of data over time) generated when the User uses the Application.
4. Purposes of Processing User Information
4.1. The Operator collects and processes User Information for the following purposes:
(1) processing is necessary to fulfill the Operator's obligations to the User under the User Agreement on the use of the Cuber Tech mobile application;
(2) processing is necessary to provide the User with access to the features and services of the Application;
(3) processing is necessary to enable the User to use the Application's features and services;
(4) processing is necessary to comply with legal obligations;
(5) when required by applicable law, processing is necessary to protect the Operator's legitimate interests if such processing does not significantly affect the User's interests, fundamental rights, and freedoms.
When processing User Information on this basis, the Operator will always strive to balance its legitimate interests and the protection of the User's privacy.
4.2. The Operator may process User Information to protect its legitimate interests, including in the following cases:
(1) to improve, modify, personalize, or otherwise enhance the Application’s features and services for the benefit of all users;
(2) to generate anonymized statistical information and metadata generated when the User uses the Application.
4.3. The Operator processes User Information only for specific purposes and only that User Information which is relevant to achieving such purposes.
5. Conditions for Processing User Information
5.1. User Information may be stored on the Operator's resources for the duration of the User's use of the Cuber Tech Application in accordance with the terms of the User Agreement on the use of the mobile application, as well as for 3 (three) years after the User ceases to use the Application.
6. Measures for Proper Organization and Ensuring the Security of User Information
6.1. When processing User Information, the Operator takes all necessary legal, organizational, and technical measures to protect it from unlawful or accidental access, destruction, modification, blocking, copying, provision, dissemination, as well as other unlawful actions in relation to it. The security of User Information is ensured, in particular, through the following methods:
(1) issuing documents that define the Operator's policy regarding the processing of User Information;
(2) applying legal, organizational, and technical measures to ensure the security of User Information during its processing in the Operator's information systems.
7. Access to the Policy
7.1. The current version of the Policy is available in the Application and on the Operator’s official website at: http://cubertechfzco.com/privacy
7.2. The Policy may be changed by the Operator unilaterally. Notification of changes to the Policy is posted in the new version of the Application and/or on the Official Website. These changes take effect from the date of publication unless otherwise specified in the respective publication. In case of discrepancies between the versions of the Policy in the Application and on the Operator’s official website, the version provided in the Application takes precedence.
